Started by Brian Browe, the petition states:
We are creating a destination transit marina in our lovely State of Michigan which will cater to Michiganders and all boaters of the Great Lakes.
We’re proposing 150 boat spaces on the Island as well as access by vehicle for 106 cars via a bridge.
A restaurant-pool bar will also be constructed on the property with an unique opportunity to capture the beauty and iconic views of Lake St. Clair. This location is also proposed to host tent weddings
We could use some assistance. Our plan is to have a resort style swim-up pool bar and currently, the Michigan DEQ has jurisdiction on Commercial Swimming Pools.
The rule R 325.2192 Swimming Pool Use restricts consumption of beverages within the pool.
Please see two (2) rules restricting our plan:
R 325.2192 (8c) – Prominently display a sign conveying requirements for safe and sanitary disposal of all food wastes and preclude consumption of food and beverages within the pool.
R 325.2192 (10) A swimming pool owner shall prominently display, at the pool, a sign warning against the use of a pool after the consumption of alcoholic beverages.
These rules are restricting swim up pool bars while competitors in Put-In-Bay, Ohio are allowed this attraction. We feel that is a disadvantage for Michigan.
According to the DEQ rep Karen Beauchamp, the rules have been unchanged since 2001 and are due for some adjustments. She recommended that I reach out to our representative which is Gary Eisen.

What Brian doesn’t tell everyone is that he is pushing this change of Michigan Law for his own personal financial benefit. He is invested in developing property that is located in very close proximity to the St. John Marsh in Clay Twp., which is a protected wetland area. I’m not against swim up bars and would probably have signed this petition were it not for the fact that he wants this change for his own financial benefit so that he can disrupt a very quiet rural area within the St. John Marsh with live entertainment and traffic that this area cannot support. Brian – Build your restaurant and Marina with the beautiful sunset views, but, PLEASE leave the tranquility of the Marsh.
